Here's the latest:

I've checked in to the cost of having a definitive legal opinion drawn up regarding the current HOA. It's ranging from $3000 to $5000. I know some of you have expressed concern about having your name tied to this HOA without a clear written legal opinion. I feel that this is an expenditure that is burdensome to moving forward. Therefore let's put it to a vote amongst us. Please respond to this email in a reply email and let me know where you stand. If we can agree to move forward then I am prepared (and have set in motion) to establish an operating account (I'll fund the first $500) and mailbox within 24 hours. The operating account can legally be opened up in the name of Cross Tie Homeowner's Association. As well, I would like to send out the initial HOA letter that you should all have a draft of. I've made a slight change to it (see below).

I spoke to Leslie (she is copied on these emails) about getting several things accomplished:

  1. A written and legally binding document from Scott Price that provides for proper rights, access and protection for the irrigation system to be moved to the property adjacent to the Lakes and the same for permission to move the pump and tank from the barn area to a new location that will server our HOA irrigation system.
  2. Clarification and commitment of the additional $2000 from Sweetwater (Which Scott aluded to in previous conversations) for moving the irrigation system.
  3. A final list of property owners (she will have a paralegal go to the county records and develop this).

I spoke with David Frost who in turn spoke with the Lakes. They are willing to allow us to hook up a system to the existing well head on their property until we can get it moved to the adjacent property. They will also physically help move these items (pump and tank) with their flatbed/ tractor / etc. I think it's a step forward. We can go ahead and file a police report and / or battle this thing out in court but in the long run it could very well cost us more. Please reply in favor of relocating the irrigation system or challenging the Lakes. Consider this a vote. We need to move forward one way or another. David has kindly offered to handle the project of irrigation system relocation should we all agree that's the correct direction.
