This is how the original Article I, Section 6 read before Herb Mayer and Sweetwater Holdings illegally attempted to modify it:

It is Interesting to note that Sweetwater Holdings is attempting to "insert" their corporation as the "Declarant" based on Article VIII, Section 5 which states the "Declarant" has the right to amend from time to time. It is apparent they put the 'cart before the horse' on this one. They tried to make themselves (Sweetwater Holdings) the "Declarant" by relying on the article that states the "Declarant" has the right to do so. If they felt that Herbert Mayer was the "Declarant" and was able to execute this filing, keep in mind that as of Aug 1996, Herb's company "Cross Tie Ranch Limited Partnership" was bankrupt AND he had resigned as an officer of Cross Tie Ranch Homeowners Association. PLUS, Sweetwater Holdings had purportedly already turned over the BLACK BEAR HOA to Hank McDaniel on Nov 14, 2000. Here they are trying to modify the original CTR HOA CC&R's. The bottom line is that neither Sweetwater Holdings, Herbert Mayer or Leslie Campione had ANY AUTHORITY to file this document making it null and void.

But even more stunning then the attempt to insert "Sweetwater Holdings" as the declarant in this filing is the fact that the filing purportedly attempted to change the name from Cross Tie Ranch Homeowners' Association, Inc. to Cross Tie Ranch of Lake County Homeowners' Association, Inc. According to Lake County public records, that is how Article I, Section 3 reads today. Here is how the ORIGINAL Article I, Section 3 read:

Amazingly, Cross Tie Ranch of Lake County Homeowners Association is the entity that is purportedly authorized to govern the Cross Tie Ranch Homeowners Association.
