Dear Art,
I am writing to you to express my concerns about the state of affairs here at Cross Tie Ranch.
Let me start by saying that I decided to move out here because my brother-in-law and his family have lived out here for several years and my family and I would visit from time to time, and we enjoyed the serenity of the area, the distance from major metropolis, and the excellent elementary school next door.
The very day I moved in and started working around the house, neighbors walking their pets would stop and discuss their problem with living here. The list of grievances were numerous, from landscaping issues to the H.O.A. being an illegal association. The more people I met the more complaints I would encounter. I also had many complaints, but they were more of the nature that I had never had to live under rules before, and after living here a year and seeing how much my property had increased in value, I understood the benefits of rules.
The first point on contention I had was at the attorney’s office, when an unexpected cost appeared on my closing statement for $500. I refused to pay it and the attorney assured me that the H.O.A. was legal in demanding the dues at closing. The only way I could move in was to pay the extra $500. I thought it very unprofessional of the H.O.A. to not take the time to introduce themselves before taking my money. Then there’s the family at the end of the street that feel they must break the sound barrier every time they drive by, and out of desperation, I was willing to cover the expense of a speed bump to deter the speeding, but getting nowhere with the association have resolved to just not letting my children out of the driveway. But the one issue that still haunts me is this common grounds issue. I do not know Mark Carson, but I have heard enough to know the man is no good. Anything associated with him stinks. If he is the owner of the common grounds, no good outcome can be expected. I interviewed with legal counsel to ensure that in the event our H.O.A. decides to negotiate with him that we as home owner are not burdened with extra costs for something that is supposed to be ours to begin with. That is the one and only burning question I want answered. Every time someone asks about it, they get the same reply about it being in litigation.
I feel by paying my dues every year without this issue being resolved, I am enabling you to continue keeping us in the dark. For my dues, I should at least have some clue as to where we are headed with this issue.
If indeed the H.O.A. intent is to reward Mark Carson shady dealings with a purchase offer, it will not come from me. If you let me know which way this case is going, I can have ample time to put my home up for sale and leave.
I hope you understand my position, and provide me with a satisfactory answer and in return, I will send you a check for the dues.
